Limitation of Liability
To the maximum extent permitted by applicable law, DataWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- • Loss of profits, revenue, data, or business opportunities
- • Business interruption or loss of goodwill
- • Costs of procurement of substitute goods or services
- • Any other intangible losses
This limitation applies regardless of the legal theory upon which the claim is based, whether contract, tort, negligence, strict liability, or otherwise, even if DataWise has been advised of the possibility of such damages.
Consequential Damages Exclusion
In no event shall DataWise's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using our services during the twelve months preceding the claim, or one hundred euros, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
Force Majeure
DataWise shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, labor disputes, governmental actions, communications or power failures, or equipment failures. During such events, our obligations under these Terms and Conditions shall be suspended to the extent affected by the force majeure event.
Legal Information and Dispute Resolution
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Jurisdiction
Subject to the dispute resolution procedures below, you agree to submit to the exclusive jurisdiction of the courts of Cyprus for the resolution of any disputes arising out of or relating to these Terms and Conditions or your use of our services. You waive any objection to venue in such courts based on inconvenient forum or otherwise.
Dispute Resolution Procedures
In the event of any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or your use of our services, the parties agree to attempt to resolve the matter through the following procedures:
Step 1: Informal Negotiation
The parties shall first attempt to resolve the dispute through good faith negotiations. Either party may initiate negotiations by providing written notice to the other party describing the nature of the dispute.
Step 2: Mediation
If the dispute cannot be resolved through informal negotiation within thirty days, the parties may agree to submit the dispute to mediation under the rules of a mutually agreed upon mediation service.
Step 3: Legal Proceedings
If mediation is unsuccessful or if the parties do not agree to mediation, either party may pursue legal remedies in accordance with the jurisdiction provisions set forth above.
Severability Clause
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent. If modification is not possible, the invalid provision shall be severed from these Terms and Conditions. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.
Terms Modification Policy
DataWise reserves the right to modify these Terms and Conditions at any time. When we make changes, we will:

- • For material changes, provide reasonable notice through our website or via email if you have provided contact information
